Terms of Service

1. Acceptance of Terms

By accessing or using Karozell (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

2. Platform Description

Karozell is an online marketplace that connects individual car owners with potential buyers. We do not buy, sell, or own any vehicles listed on the Platform. Karozell acts solely as an intermediary facilitating communication between buyers and sellers.

3. Eligibility

You must be at least 18 years of age and a resident of India to use the Platform. By registering, you represent that all information you provide is accurate and complete.

4. Owner-Only Policy

Karozell is exclusively for individual car owners. Dealers, brokers, and intermediaries are strictly prohibited from listing vehicles. We verify ownership through Registration Certificate (RC) matching. Violation of this policy will result in immediate account suspension and listing removal.

5. Listings

• Each user may have a maximum of 2 active listings at any time.
• Listings automatically expire after 30 days and may be renewed.
• All listing information must be accurate and not misleading.
• Karozell reserves the right to remove any listing that violates these terms.

6. User Conduct

You agree not to:

• Post fraudulent, misleading, or deceptive listings
• Impersonate another person or misrepresent your identity
• Use the Platform for any unlawful purpose
• Harass, abuse, or threaten other users
• Attempt to circumvent any security features of the Platform
• Scrape, spider, or crawl the Platform without authorization

7. Transaction Disclaimer

Karozell does not participate in, guarantee, or mediate any transaction between buyers and sellers. All negotiations, inspections, payments, and transfers of ownership are conducted directly between the parties. Users are advised to exercise due diligence, verify vehicle condition, and complete proper documentation.

8. Intellectual Property

The Karozell name, logo, and all associated content are the property of Karozell. Users retain ownership of content they upload (photos, descriptions) but grant Karozell a non-exclusive license to display such content on the Platform.

9. Data Protection & Privacy (DPDP Act Compliance)

We process your personal data in accordance with the Digital Personal Data Protection Act, 2023 and our Privacy Policy. By using the Platform, you:

• Provide free, specific, informed, and unambiguous consent for data processing as described in our Privacy Policy
• Acknowledge that your name, city, and listing details will be visible to other users
• Consent to receiving transactional communications (which you may manage via email preferences)
• Understand that RC images are processed for verification and immediately deleted
• May withdraw consent or request data deletion at any time by contacting privacy@karozell.com

10. Intermediary Status (IT Act)

Karozell operates as an intermediary under Section 2(1)(w) of the Information Technology Act, 2000. We comply with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. We do not initiate, select, or modify any content transmitted by users. Users are solely responsible for the accuracy and legality of their listings and communications.

11. Grievance Redressal

In accordance with the DPDP Act, 2023 and IT Act, 2000, we have appointed a Grievance Officer:

If you are dissatisfied with our resolution, you may escalate your grievance to the Data Protection Board of India as constituted under the DPDP Act, 2023, or approach the appropriate authorities under the IT Act, 2000.

12. Limitation of Liability

To the maximum extent permitted by law, Karozell shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform. We do not guarantee the accuracy of listings, the condition of vehicles, or the reliability of other users.

13. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India, including but not limited to the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and the Indian Contract Act, 1872. Any disputes arising shall be subject to the exclusive jurisdiction of the courts in [Mumbai/registered city], India.

14. Modifications

We may update these Terms of Service at any time. Material changes will be notified via email to registered users. Where changes affect the basis of consent under the DPDP Act, fresh consent will be sought. Continued use of the Platform after notification constitutes acceptance of the updated terms.
